Domain General: Change of Ownership Issue

I am both Admin and Billing contact for my domains... and yet I cannot
change the owner, because the owner email address is incorrect.

I cannot change the owner email address because I can't remember the
password.

I can't get the password because the email address is not valid.

I'm not willing to have to go through the process of proving who I am
via the form you supply.

Besides, this workflow does not jive with my understanding of the
Administrative role. My understanding is that an Admin should be able
to make any change to the domain registry. Am I wrong about that?

I have the exact same problem.  Seems that somehow the owner handle was
changed from xxx1-GANDI to xxx3-GANDI, and I am not authorized to
change it.  The owner handle xxx3 has missing/incorrect email address. 
The change was not made by me.  Gandi support has been notified, but I
have not yet received an answer.

box was full. Therefore , their system automatically defined the

with it, Gandi made a separate "owner" account for me, WITHOUT MY
CONSENT, having no email address listed for it. So, I cannot login
because I don't have the password. I don't have the password because I
didn't make the account. The account doesn't have a valid email id

email listed. 
How can the whois have NO EMAIL listed??? It is a requirement.

They expect me to send my personal documents, a letter of incorporation
of the company and probably my soul before they will transfer ownership
to me. 
What sort of extortionate business does this? I have used various domain

I don't even expect my money back, which rightly, I should. I just want
control of my domain name. 

It seems I have to prove that I am a real human being to them. If I had
the authorization to initiate a transfer process to them, I think that
should be sufficient evidence that I am the owner.

And of course, all this hassle and extortion is FOR MY PROTECTION. :)

We still manage abour 100k domains without a valid email for the owner.

We forbide the possibility to change the owner of a GTLD (com, net..)
domains in case of transfer in for security purpose. Our business is
a technical and mainly a legal business.

Once again, it's our business to protect your domain. More and more people
loose their domain because the thought this was a sufficient evidence.

forgotten about me. This is the email which I sent to your customer
care which I have got no response from.

It is your business to protect my domain, I agree. It is not your
business to steal my domain's control from me. I don't want a change of
owner. I just want an email address associated with the owner account,
an email address which WAS ALREADY LISTED in the whois registry before
the transfer to Gandi.net.

You have my driver's license. If I am a thief, please send the police
after me. Send them to my house. But till then, please associate the
email address originally listed with my owner account.

I am not trying to steal the domain from someone else. You already have
a copy of my driver's license and my house address. It is the same as
the Owner's address of my site. I can forward all emails which you sent
to me first asking for my permission, then confirming the transfer.
Those emails were sent to the REGISTERED email address for my domain
(which did exist). Now I find no mention of that email address
anywhere. Why is that? If you copied the whois details so carefully,
shouldn't the email address also have been taken?

And if you say that there was no email address listed with the domain,
then why did I receive emails on that email address? It isn't listed
anywhere in my account. It is because THAT was the email listed for my
domain.

I have those emails stored with all the message headers and I will
forward them all to you in case you wish it.
I received 5 emails from Gandi.net and 3 emails from GoDaddy asking for
my permission and confirming the transfer.

My case no. is 510954 if you wish to follow it up.

This is the email I sent to the person in customer care I was speaking
to.

Let me clarify some things to you so that the facts are clear to both of
us.

Firstly, the domain <domain>.com did have a valid email ID associated
with it. That email ID was <email address>. If you want, I can forward
you the emails which my former registrar GoDaddy sent to me confirming
the transfer request. Furthermore, I can forward you the emails which
YOU ( GANDI.NET) sent to me confirming my transfer. Those emails were
sent to <email address> as that was the registered email address. I am
ready to forward these emails if you so wish it.
This proves that there was an email address associated with
catalyseintl.com. But when my owner handle was made, which I did not
ask for, this information was very conveniently not included in that
handle. Why is that? If you would be so kind as to provide me with an
answer, I would be grateful.

Secondly, I am listed as the Administrative, Technical and Billing
contact for the domain. Do you think I am lying? I also have ownership
of the email address <email address 1> and of <email address 2>. These
email addresses are or were associated with this domain name. I think
that is SUFFICIENT proof that I am the owner.

Furthermore, I made the transfer to Gandi.net. I had access to the
authorization key. This again proves that I am the owner.

Why not let common sense prevail and just let me have ownership of a
domain which I own?
As for the documents you need, I have sent you my driver's license,
which has my name and address listed. This address is the same as the
OWNER ADDRESS. It is also the same as the Technical, Administrative and
Billing address. This proves that I am the owner. I do not think it is
NECESSARY that I send you any documents of my company. No other
registrar has ever asked for such documents.

Needless to say, I am very unhappy at the current state of affairs.
All I want is a simple change of email address. It is not that hard to
do.

I do not wish to wait another 24 hours for your email, only to be told
that I need to send additional documents.

Please help me get ownership of the domain which I OWN. I have made the
transfer to Gandi and have paid you money for the service of being my
registrar. Please act like you are on my side and give me some service
and support.

If you are unclear about any of the things written above, please do not
hesitate to contact me and I will explain everything further.

Can you please let me know exactly when it became a requirement? The
registrar GoDaddy had it as a requirement.

Why I ask you this is because my domain is fairly new. It was created on
the 9th of June, 2005. Was it a requirement to have an email address in
2005?
Please provide sufficient evidence if it was not.

And if it was a requirement, then that just proves my point.

This was 6 days ago. All I received was notification that the ticket had
been opened, and a promise to get back to me.

Hello,

The owner of the domain name catalyseintl.com is Catalyse International.
The owner of  catalyseintl.com before the transfer of the domain name to
Gandi was Catalyse International, and as listed in the whois before the
transfer, you can see that the former registrar did not include an
e-mail address for the owner:

   Catalyse International
   H-3, Green Park Extension
   New Delhi, Delhi 110016
   India

Because the owner of a domain does not change during a transfer, the
Gandi handle CI622-GANDI was created from the whois information
provided by the former registrar as belonging to the owner of the
domain. This is why a new owner handle was made, and why there is no
e-mail address associated with it.

In order to change the owner, or information about the owner (such as
the e-mail address) it is necessary to demonstrate that the person
making the request is the owner of the domain. In this case, the owner
is the company, "Catalyse International" and not "Vishrut Singh Seera".


Consequently, in order to proove that you are the owner or entitled to
act on behalf of the owner of the domain name, we require, for any
change to the owner account:

- A valid and current legal document (such as a certificate of
incorporation) in the name of "Catalyse International", the owner of
the domain. This document must display the name of the company, and the
name of the person who is entitled to act on behalf of the company
(president, CEO, Director, etc).

- A government-issued photo ID of the person who is named on the
aforementioned document,

- The e-mail change form (in the case of such a procedure) that states
and is signed by the name of the person listed in the legal document of
the company, and on the ID provided.

The combination of these three documents is what will allow us to verify
that you have the right to act on behalf of the owner of the domain
name. 

Upon the reception of these documents, the requested change may occur
rapidly.

I replied to your support request on Mon. Mar.19 at 14:45:28.
I just sent it again.

Basically, you cannot change the email address of an owner handle as the
administrative contact, because this owner handle may own domain names
you might not be the administrative contact of.

Thus, the only way to change the email address of the owner handle is to
follow the procedure by form.

I have replied to you via e-mail concerning the resolution of this
affair, which is now closed.

As a general note to all reading this thread: when no e-mail address has
been provided to Gandi by the former registrar, we send the transfer
authorization e-mail to the e-mail address of the administrative
contact of the domain. 

In many cases, registrars do not have a separate e-mail address listed
with the owner of a domain, which can lead to a problem of
inaccessibility following a transfer - especially if the name of the
administrative contact is not the same as the owner.

Before initiating a transfer, please ensure that the whois data for the
domain's owner is correct and up-to-date, and that your registrar has
listed a specific e-mail address as belonging to the owner.

My experience is that GANDI does NOT respond - and I believe a scam may
be involved here

Yes - it's been a disaster for me also. Several emails to GANDI Support
and not a single answer.

Dozens of emails simply lost - every day. The "email reminder" service
for the ownership change apparently does not work also - not a single
email about ownership change confirmation. It feels like this system is
a front.

If I don't get some semblance of support in the next few days - I'm
transferring everything.
