Terms and conditions
Welcome Gandi.net Discussion Groups!
In compliance with Gandi's terms of use of the Gandi website, consultation and use of GandiGroups or Gandi Forums requires acceptance and adherence to the terms of this Code of Conduct. Any message/posting that does not follow the rules noted in this Code may be deleted.
Preamble
What are GandiGroups?
GandiGroups are public areas for discussion that are at your disposal. These areas are put in place by Gandi as a form of self-help for the various services provided. Gandi publishes all conversations online via a web interface and via the Usenet System (hereafter referred to as “GandiGroups” or “Forum(s)”).
These areas are open to both clients and non-clients of Gandi wishing to exchange ideas on any Forum theme with Gandi or Gandi users.
For example, the Forum dedicated to the GandiBlog service allows you to ask a question about, or make a comment on the use of this service; you may also consult the knowledgebase that is automatically generated from participants’ conversations.
How is this different from the Customer Care Department, which is also free and open to everyone?
The Forums go beyond the help provided in the Customer Care Platform in that they are published on the internet, and they are organized by theme. You also have access to a knowledgebase centered on the service of the theme. Such a system will allow you to explore certain questions in greater detail. You may, for example, ask technical questions regarding the CSS (Cascading Stylesheet) personalization for your blog, which are not specific to our GandiBlog service.
Gandi Forums are available via both a web interface http://groups.gandi.net and a Usenet server (groups.gandi.net). Both systems are connected and synchronized by us.
To participate or read GandiGroups, three main conditions apply:
- create an account (optional but recommended) (I) ,
- only post messages related to the theme of the Forum, in accordance with the goal of contributing to the self-help technical support services of Gandi (II),
- abide by all applicable local laws, the rights of third parties and any person participating or not participating in the discussions, and adhering to the present Code of Conduct. In short, respect others and do not post illicit or prejudicial comments about others! (III)
We may directly or indirectly censor postings after they have appeared on GandiGroups, as described below (IV).
These summary points being stated, here are the specific details of our Code of Conduct.
I. Create an account, identify yourself
GandiGroups are public discussion areas intended for those who would like to obtain information or details about Gandi's services (mainly technically-related).
In order to use special options, such as the ability to follow certain discussion threads, or the addition of a signature, you must subscribe to the free service by creating an account on our website at: http://groups.gandi.net/ .
During the subscription service, you must indicate a valid e-mail address, which is necessary for the activation of your account and its use. The password associated with your account is strictly personal and under your full responsibility. Any contribution made via your account will be considered as being written by you, and will thus be your responsibility. You must take all possible measures to insure that your password remains confidential, and you must formally and immediately inform us in the event that your password becomes public or revealed to an unauthorized third party.
You are not obligated to create an account if you only want to read postings on the Forums. No particular criteria are necessary for opening an account, as the Forums are areas that are open to the public for discussion.
Unless your e-mail address, or any other element of your contact information, are provided in the content of a message posted in the Forum by either you or a third party, they will not appear in the Forums.
Please note, however, that given the nature of the Usenet system and how it operates, both your e-mail address and connection IP address will be visible in all Usenet sections of Gandi’s Forum.
It is also to be noted that, in accordance with all applicable local laws, upon the request of a competent authority, Gandi may be obliged to communicate your e-mail address, your internet connection IP address, or any other piece of information that may identify you.
This data constitutes personal information. Please note that as a matter of principle, we only gather information that is necessary to the proper functioning of the Gandi service that you are using. In the case of Forums, this constitutes your e-mail address and your connection IP address, both of which are stored and processed in accordance with all applicable local laws, and for the exclusive needs of the operation of the service. We will not sell this data.
You have the right to access, correct, and request the removal of personal information about you. To exercise this right, please contact us at the address indicated below. However, the right to request the removal of personal information may lead to the total or partial suspension of access privileges to GandiGroups, as well as, if requested, the deletion of all related postings, depending on the data that you request to have removed.
II. Adhere to the Forum’s Theme
The purpose of the Forums is to allow users to help each other use the related Gandi service.
This is a free, self-help service that allows you to have conversations with others, and to ask questions, mainly technical, that pertain to the service for which the Forum is devoted.
You agree to stick to the theme, objective, and self-help nature of the Forum when you post messages on the Forum.
In particular, you shall not post any messages that may be deemed advertisements, spam, personal revenge, or any other topic that does not satisfy the objective of allowing the members to help each other use Gandi’s services.
III. Do not infringe upon the rights of third parties or violate local applicable laws: you are held liable for the content that you post on GandiGroups
Gandi does not monitor the content of messages at the time of their posting, and cannot therefore be held liable for the content of your postings.
You are fully liable for all content that you publish, send, or make available to the public via GandiForums, including, but not limited to, all information, data, text, software application, music, sound, image, photograph, graphic, drawing, video, goods, product, service, sign, signals, published writings or messages of any nature (hereafter referred to as “Content”).
All Content is public by its very nature, so that any person who has an internet connection can view it and publish their own Content on the GandiGroups.
You affirm and agree that the Content of your messages adheres to all applicable local laws, and does not infringe upon the rights of a third party.
In particular, you commit that your postings shall not contain any Content that offends human dignity; pertains to, or may be considered in nature to be, child pornography; that is racist, xenophobic, or revisionist; that contains any provocation of, or incitation to commit crimes, misdemeanors, and in particular crimes against humanity, racial hatred, violence, suicide, incitation to the use, fabrication, or distribution of illegal or unlawful substances, incitation to acts of terrorism; that is immoral, or disrupts public order or the proper functioning of public offices; that contains any insult, slander, or violation of a public or private figure's private life, or violation of image rights; that infringes upon trademarks or intellectual property rights; and/or that contains any hyperlink that points to a website where the Content would be in violation of current local applicable laws.
Even though this list is not exhaustive, the presence of such Content would not only be a violation of the Forum theme and a violation of the present Code of Conduct, but shall also justify the deletion without notice of the offending posting(s) in addition to the application of penalties as required by current applicable local laws for such acts.
IV. Modification of GandiGroups
We will assign one or more moderators per Forum, in such a way as to monitor the adherence to the theme of the Forum and to the answers provided, pertaining to aspects of our services.
The moderators of GandiGroups will either be Gandi employees or users of GandiGroups that have been recognized for their pedagogic abilities and patience.
These moderators will manage the Forum, and may freely use and modify the Forum’s Content via a special interface.
The moderator is not a policeman or a guard. Like any other user, he/she must assure the serenity of discussions and the pertinence of the postings.
Moderators do not monitor messages before they are posted. They may, without fear of retribution from the author of a message, suspend or delete one or more messages after their posting on the Forum, in the event that the Content does not adhere to applicable local laws, the present Code of Conduct, and/or represents an infringement on the rights a third party, whether illicit or prejudicial, if they are notified of or discover the existence of such content during a control. In such an instance, the deletion will occur without notice.
You may also, as a member of the Forum, make a call to order or flag illicit or prejudicial Content by writing to us at abuse@gandi.net (specify “GandiGroups” in the subject of your message). In addition, you will dispose of an interface that will allow you to notify us of the presence of such content.
This aforementioned address and interface will also allow you to request the deletion of one of your messages, if you are able to prove that you are the author (identification by password, e-mail address or IP address). Note that such a removal may only apply to the GandiGroup website. To cancel your message from the Usenet system, use the “cancel” function of the newsreader that you are using to access Usenet.
You also have the “right to correction”, allowing you to directly and publicly refute any posting about you that contains a false assertion or statement of any nature about you. You may exercise this right at any time by publishing a post to this affect in the Forum, provided that you adhere to the Code of Conduct and do not infringe upon the rights of third parties.
Please note that, given the composition and nature of the internet, which is decentralized, we cannot guarantee the deletion of the Content outside our own servers. This is particularly the case concerning references on internet search engines, other discussion forums or websites, or in Content that has been downloaded by Usenet subscribers.
